The municipal capital gains tax (plusvalía municipal) is a mandatory tax to consider when transferring a property in the Catalan capital. Its technical name is the Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana (IIVTNU) (Tax on the Increase in Value of Urban Land) and it is managed directly by the Barcelona City Council.

Contrary to what is usually thought, this tax does not levy the total transaction value or the construction price. Its objective is to exclusively tax the increase in value of the urban land on which the property stands during the years it has belonged to the seller or transferor.

Currently, following legislative reforms, there are two estimation methods, and it is possible to declare non-subjection (no sujeción) if it is proven that the property was transferred at a loss.

What exactly does this tax levy?

The municipal capital gains tax applies to the increase in value of urban land that arises at the time of transferring property ownership, or when establishing or transferring any real right of enjoyment over it.

This tax is mainly accrued in the following scenarios:

  • Sales: Typical onerous transfers.
  • Inheritances: Property transfers due to death.
  • Donations: Free transfers between living persons (inter vivos).
  • Establishment or transfer of usufructs.

It is important to emphasize that this tax does not apply to rustic land (classified as such in the Impuesto sobre Bienes Inmuebles or IBI [Property Tax]). Furthermore, when we buy or sell an apartment in a building under a horizontal property regime, the calculation is not performed on the total cadastral value of the property, but only on the proportional part corresponding to the land consult the cadastral value of the land.

Who must pay the municipal capital gains tax in Barcelona?

The law clearly determines who the taxpayer (sujeto pasivo) obligated to pay is, depending on the nature of the transfer agreement:

1. In a sale (Onerous transfer)

The tax-obligated party is the seller, as they are the one experiencing the increase in land value while being the owner. Even if the buyer and seller privately agree that the buyer will assume this cost, these types of agreements do not exempt the seller before the Tax Administration, which will always claim the payment from them.

If the seller is an individual who is non-resident in Spain, regulations establish that the buyer acquires the status of taxpayer substitute (sustituto del contribuyente). 2. In an inheritance

In transfers due to death, the taxpayer is the heir or legatee who acquires the property.

3. In a donation (Gratuitous transfer)

In this case, the person obligated to make the payment is the donee (the person who receives the property free of charge). Submission Deadlines and Extensions

The calculation of legal deadlines in Barcelona depends on the type of transfer and begins on the accrual date (the date of signing the sale/donation deed or the date of death in the case of inheritances):

  • Inter vivos transfers (Sales and Donations): The deadline is 30 business days from the transfer date.
  • Mortis causa transfers (Inheritances): The general deadline is 6 months from the date of death.

For inheritances, it is possible to request an extension of an additional 6 months (reaching a full year), provided it is formally requested from the Barcelona City Council (Ayuntamiento de Barcelona) within the first six months of the period.

Calculation Methods for the Municipal Capital Gains Tax (Plusvalía Municipal)

Since the entry into force of the new state regulations, taxpayers in Barcelona can choose the calculation method that is most favorable to them between the Objective Method and the Real Method.

The Objective Method

This system estimates a theoretical increase in value. It is calculated by multiplying the cadastral land value by a multiplier coefficient that depends on the number of years the transferor has owned the property (with a limit of 20 years).

The tax rate set by the Barcelona City Council is applied to the resulting tax base (with a legal maximum of 30%).

  • Identification of the land value: This figure appears clearly broken down in the latest IBI (Property Tax) receipt, separate from the building value.

The Real Method

This method calculates the actual increase based on the difference between the acquisition value and the transfer value of the property, applying the percentage that the cadastral land value represents over the total cadastral value.

If the result of the actual increase is lower than that obtained through the objective method, the taxpayer can choose to be taxed under the real method.

When is the municipal capital gains tax not paid?

The transaction will not be subject to the tax when it is formally proven that there has been no increase in value between the acquisition and transfer dates (that is, when it is sold or transferred at a loss).

To benefit from this non-subjection in Barcelona, it is imperative to complete the declaration process by providing:

  1. Deed proving the previous acquisition.
  2. Deed formalizing the current transfer.
  3. IBI (Impuesto sobre Bienes Inmuebles/Property Tax) receipt showing the cadastral reference and the land value.

In addition, the law provides for specific tax reliefs (of up to 95% in Barcelona) for transfers by inheritance in favor of descendants, ascendants, or spouses, provided that the relationship and habitual residence conditions are met.

Plusvalía municipal vs. Ganancia patrimonial (IRPF)

It is common to confuse these two tax concepts when planning the expenses and taxes of the sale. However, they operate independently:

  • La Plusvalía Municipal (Municipal Capital Gains Tax) taxes the value of urban land and is paid directly to the Town Hall.
  • La Ganancia Patrimonial in the IRPF (Personal Income Tax) taxes the total net profit from the sale (sale price minus purchase price and deductible expenses) and is declared in the tax return campaign before the State Tax Agency.

Therefore, it is possible to have to declare the objective plusvalía municipal even if no real capital gain has been obtained under IRPF, or vice versa, depending on the applicable land valuations.
